Overview

These Terms of Service (the “Terms”) apply when you use our website and online shop (the “Services”). They set out your rights and responsibilities, and ours.

Nothing in these Terms affects your statutory rights under UK law (including under the Consumer Rights Act 2015).

Our online shop is powered by Shopify, which provides the platform we use to sell products online. Your contract for any purchase made through our online shop is with Bicyclenation, not Shopify.

Using the Services

  • You must be at least 18 years old to place an order.
  • If you create an account, you are responsible for keeping your login details secure.
  • If you provide information to us (for example, delivery or billing details), it must be accurate and kept up to date.

Products and information

We aim to describe products accurately. However, colours and product appearance may vary depending on your device and settings.

Product availability can change. We may update or remove products from the website at any time.

Orders and contract

When you place an order, you are making an offer to buy a product.

We will confirm receipt of your order, but this does not mean your order has been accepted. Your order is accepted when we send you a dispatch confirmation (or when we otherwise confirm acceptance in writing).

We may refuse or cancel an order (for example, if a product is out of stock, there is a pricing error, or we suspect fraud). If we cancel after taking payment, we will refund you.

Prices and payment

Prices, promotions and availability may change from time to time. The price you pay is the price shown at checkout when you place your order.

Delivery charges and any other costs (if applicable) will be shown during checkout before you pay.

Delivery

Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by couriers, customs processing, or events outside our control.

For consumer orders, risk in the goods remains with us until the goods are delivered to you (or to someone you nominate to take delivery).

Returns, refunds and cancellations

Returns, refunds and cancellations are handled in accordance with our Return Policy, in addition to your statutory rights.

Intellectual property

The Services and all content on them (including text, images, graphics, and logos) are owned by or licensed to Bicyclenation and are protected by intellectual property laws.

You may use the Services for your personal, non-commercial use. You must not copy, reproduce, distribute, or create derivative works from our content without our written permission.

The Services may include links to third-party websites or services. We are not responsible for third-party content, products, or services.

Liability

Nothing in these Terms limits or excludes our liability where it would be unlawful to do so, including for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation.

If you are a consumer, we are responsible for foreseeable loss and damage caused by us. We are not responsible for losses caused by events outside our reasonable control.

If you use the Services for business purposes, we are not liable for business losses (including lost profits, lost revenue, loss of business, or loss of goodwill).

Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page.

Governing law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

If you are a consumer, you may bring a claim in the courts of the part of the UK where you live. Otherwise, the courts of England and Wales shall have exclusive jurisdiction.
